3. Object and scope
3.1. These General Sales Terms and Conditions exclusively govern the purchase and sale made on the healsi.eu online store, between the user as a consumer and healsi as a seller and apply to all users of the website www.healsi .eu, as well as any transaction of a commercial nature carried out through this virtual online store.
3.2. Healsi will be the entity responsible for the sale on the website www.healsi.eu, and all e-commerce services are only available to consumers.
3.3. A consumer is a natural or legal person who acts/buys with a purely personal purpose, with purposes that do not fall within the scope of their commercial, industrial, artisanal or professional activity, therefore, without any intention of reselling the products they purchase at the healsi online store.
3.4. To make a purchase on www.healsi.eu, the user or consumer must be over 18 (eighteen) years of age and have the legal capacity to enter into contracts.

3.7. Healsi reserves the right not to process any orders received from users who are not end consumers, or those who do not comply with the Healsi Seller's General Terms and Conditions of Sale.
3.8. The consumer must provide Healsi, as the seller, with an e-mail address, postal address, or other contact information that is correct and complete and agrees that Healsi may contact him using this data, if necessary to complete the sales process.

4.1. The website www.healsi.eu is intended for private use only, therefore the reproduction, transfer, distribution or storage of the contents of this online store, without prior written permission, is prohibited for any purpose other than strictly personal use.
4.2. The use of links from the website www.healsi.eu is expressly prohibited. for commercial purposes or without its prior authorization, as well as the use of the domain www.healsi.eu, with abusive purposes, without prior authorization, which will be subject to recourse to the competent legal means by Healsi.

4.4. Healsi will make every effort to ensure that the information presented on www.healsi.eu is free from typographical errors and whenever these occur, it will correct them as soon as possible.

5. Commercial Policy

5.4. Product prices and specifications are subject to change without notice. If the product price is lower than the advertised price, Healsi will refund the difference to the consumer. If the price is higher, it will inform the consumer by email and wait for their decision to accept the new offer or cancel the order.
5.4.All promotional campaigns have limited stock.
5.5. The validation of the purchase order or order assumes that the consumer is aware of and accepts the General Sales Terms and Conditions of the website www.healsi.eu.
5.6. All data registered by Healsi constitute proof of the set of transactions carried out between the seller and the consumer, being the seller's responsibility to file the electronic document in which the contract is formalized, obliging itself to keep it accessible.
6. Obligations of Customers and Users
6.1. Any visitor and/or user of the website www.healsi.eu undertakes to comply with and respect these General Terms and Conditions of Sale, namely observing the following obligations:
• It is prohibited to introduce, store or disseminate through the website www.healsi.eu defamatory, obscene, insulting, xenophobic and/or any other content that violates the general principles of law and public order;
• Save, and not disclose, your login password on the website in order to prevent third parties from accessing your account and personal data;
• Do not use false identities;
• Provide your personal data and correct addresses so that Healsi can properly process orders;
6.2. The consumer is solely responsible for the veracity of the personal data communicated to Healsi and undertakes to immediately enter and report any changes via his Registration Account at www.healsi.eu
6.3. Healsi disclaims any responsibility for any delay or impossibility of processing the order due to error or insufficiency of the data communicated by the consumer, namely at the time of delivery.
7. Online ordering
7.1. To place an order on www.healsi.eu, the consumer must have a valid and frequently used e-mail account and register as a customer by filling out the form available online. Once registered, the consumer simply inserts all the products he wishes to purchase into the virtual shopping basket, following all the steps of the order so that it can be successfully completed.
7.2. The ordering process at www.healsi.eu. will follow the following steps:
• Consumers browse the pages of the online store www.healsi.eu and find the products they want to buy;
• By clicking on the product(s), the consumer is informed about the essential characteristics of the product: technical characteristics, description, product reference and image/illustrative photograph;
• The consumer selects the product, indicating the size, quantity and adds it to the virtual shopping basket through the “Add to Cart” button;
• The consumer will be able to choose later between continuing to buy or finalizing their order;
• To continue buying, the consumer must repeat the process;
• When you understand that you have already chosen all the products you want to purchase, complete the order by clicking on “Cart”;

7.4. In case of non-confirmation of payment or non-compliance with these General Terms and Conditions of Sale, Healsi reserves the right not to accept your order, or to cancel it in whole or in part, even after its automatic confirmation.
8. Availability of products and order confirmation/cancellation
8.1. Healsi only processes an order placed by a consumer after confirmation of the respective payment, so the brand cannot guarantee the availability of the products until the beginning of said processing.
8.2. In the order confirmation you will find the estimated date for shipment of the products, after payment confirmation: 5 to 8 days
8.3. Healsi only ships orders on working days. Thus, to estimate the delivery time of orders, weekends and public holidays are not counted. Any delay verified in the shipment of products, in view of the estimated dates presented, does not confer the right to compensation.
8.4. The fulfillment of all orders placed on the website is subject to product availability. Healsi tries to ensure that all products offered for sale on the website are available for manufacture. In case of unavailability of the product for manufacture, Healsi will immediately inform the consumer of the partial or total cancellation of their order, and the consumer is entitled to a refund of the respective amount paid.
9. Order confirmation or cancellation
9.1. Healsi may not validate the order that does not have sufficient guarantee of good collection, when the order is incomplete or incorrect, or when the ordered products are no longer available for production. In any of these cases, Healsi will inform the consumer via e-mail that the sales contract has not been made and that the brand has not proceeded with the order, specifying the reasons for this.
9.2. If the products ordered on www.healsi.eu are no longer available at the time of your last access to the website, despite having obtained an order confirmation, or when Healsi receives your order, the company will immediately inform the consumer about their unavailability, never exceeding the period of x days after receipt of the request.
9.3. If an order has been placed, and payment is made, for products that have become unavailable in the meantime, Healsi will refund the money paid for the unavailable products.
9.4. In the case of orders placed, and respective payment according to the delivery plans existing on www.healsi.eu, which are given a discount, if the customer wishes to cancel the plan, the refund will take into account the loss of the discount.
9.5. Healsi reserves the right to refuse orders or to establish maximum product limits per order in the event of an obvious lack of production capacity.
9.6. Healsi also reserves the right to refuse any order, regardless of the reason and is exempt from liability for any damages or costs, as well as reserves the right to cancel any order even if it has already been accepted or confirmed by it, namely in the following situations:

9.8. Healsi will not be liable to the consumer or any third party for valid refusal to complete the order acceptance process, even after sending an order confirmation.
10. Payment Terms and Security Guarantees
10.1 Available payment methods will be displayed on www.healsi.eu. Healsi will not accept any payment method other than those mentioned.
10.2. Consumers can pay for their products by credit card, ATM or using their personal PAYPAL account.
10.3. For payments using credit card, all details (such as card number, expiry date or security code) will be sent via data encryption protocol (SSL) to the company that provides electronic payment services remote, without third parties being able to access the transmitted information. 11.3. Healsi cannot be held responsible for any damage suffered as a result of the use of electronic means of communication, namely damage arising from failures or delays in the delivery of electronic communications, from intercepts or manipulation of electronic communications by third parties or from computer programs used for communications or virus transmissions.
12. Reservation of Ownership of the products sold
Healsi retains ownership of the products in an order until it has received full payment for all such products.
13.1. The prices of the products displayed on the website www.healsi.eu contain/include Value Added Tax (VAT) and delivery charges for normal shipping, if any.
13.2. Product prices may vary due to launch price or promotional offers..
13.3. Prices are quoted at the time of order confirmation, which the consumer can print or download for future use.

14. Quality and Warranty
14.1. Healsi will not sell second-hand, defective or inferior quality products on www.healsi.eu than existing market standards.
14.2. The essential features of each product presented for sale on www.healsi.eu are available for consultation on the respective page of each product. The products may not exactly match the actual product with regard to the displayed image/photo and colors, especially due to the internet browser and monitor used.
14.3. All products sold by Healsi on www.healsi.eu are covered by the legally established warranty periods for the sale of consumer goods, as stipulated in Decree-Law no. 67/2003, of 8 April, with amendments introduced by the Decree -Law No. 84/2008, of May 21st.
14.4. Defects caused by negligence or misuse are excluded from this warranty.
15. Shipping of Products and Deliveries
15.1. Products ordered from the www.healsi.eu online store will be shipped and delivered on weekdays, from Monday to Friday (taking into account the Portuguese calendar).
15.2. The average delivery time varies between 5 and 10 business days,
15.3. Healsi does not guarantee the average delivery time for the Christmas period.
15.4. We can only guarantee excellence in the delivery service if the shipping address is correctly indicated by the user as well as all the specifications/conditions of the unloading place (eg Ground floor, unloading dock, auxiliary tools, etc).
15.5. The consumer must take care to receive the order at the address indicated by him.
15.6. The subsequent change of the delivery address, the change of the delivery method, as well as the resending of an order may incur additional delivery charges, which, if any, will be charged to the consumer.

16. Delivery (transport) expenses
16.1. For Portugal there are no transport costs. For Spain and other countries, please consult the price list on the website.
16.2. The contracted transport service only includes delivery on the ground floor.
17. Delivery Times
17.1. Once your order has been registered, payment is confirmed and all the products in your order are available, Healsi undertakes to proceed with the shipment observing the following delivery times:
17.2. In the Iberian Peninsula, more specifically in Portugal and Spain, between 5 to 10 working days
17.3. Orders will be processed within these deadlines, as long as they enter the system by 12:00 pm on the same day. After this time, orders will be processed from 09:00 hours of the following day.
17.4. Healsi will not be liable for failure to, or fulfillment of, any shipping obligation that is due to an event of force majeure, ie an event, act or omission beyond its reasonable control.
17.5. If the delivery time for the order exceeds 15 working days, the consumer can unilaterally withdraw from the order, being refunded the entire amount paid. It is agreed between both parties that they will not make any claims for damages or losses, present or future, direct or indirect, or claims for compensation for damages or loss of profit.
18. Order Cancellation
18.1. The consumer may not cancel the order, return products, or freely terminate the contract after payment of the order, as stipulated in article 17, paragraph 1 paragraph c) of Decree-Law no. 24/2014, of 14 February .

18.3. The consumer may cancel an order by not paying for it.
19. Validity of promotions or commercial campaigns

20.1. Healsi will only be liable for damages suffered by the consumer if such damages result from breaches attributable to Healsi's contractual obligations to the consumer, or if the liability arises from applicable law.
20.2. If the consumer has suffered damage in connection with the activity of the website www.healsi.eu, Healsi's liability shall be limited to damage to Healsi products, reasonable and demonstrable costs incurred by the consumer as a result of brand infringement of these Terms and General Conditions of Sale.
